Cases under Nari O Shishu Nirjatan Daman Ain, 2000:
Violence against Women and Children becoming a very common social problem in Bangladesh and it’s crating disorganization in the family. Nario O Shishu Nirjatan Daman Ain 2000 is a special law and deals with the Violence against the Women and Children. This Act has been amended in 2003 and introduced some more precise provisions in a polished manner. Now it is called Nari o Shiushu Nirjatan Damon Ain 2000 (Amendment 2003). There are 34 sections in the Nari O Shishu Nirjatan Ain, 2000.
Offences & Punishment Under the Act:
- Section 04: Offences Committed by Corrosive or any other substances
- Punishment:
i) If causes death or attempts to cause death: Shall be punished with death or imprisonment for life and also with fine up to One Lac Taka.
ii) If causes hurt in consequence of which sight or ear is damaged or face or breast or sexual organ is disfigured: Shall be punished with death or imprisonment for life and also with fine up to One Lac Taka.
iii) If causes hurt in consequence of which any limb, joint or part of the body is disfigured or damaged: Shall punished with imprisonment which may extend to 14 years but not less than 07 years of rigorous punishment and fine not exceeding Fifty Thousand Taka.
iv) Throws or attempts to throw in consequence of which injured physically or mentally: Shall punished with imprisonment which may extend to 07 years but not less than 03 years of rigorous punishment and fine not exceeding Fifty Thousand Taka.
- Section 05: Trafficking of Woman
- Punishment:
Trafficking women for prostitution: Shall punished with death or imprisonment for life or with imprisonment which may extend to 20 years but not less than 10 years of rigorous punishment and also with fine.
- Section 06: Trafficking of Child
- Punishment: Shall punished with death or imprisonment for life.
- Section 07: Kidnapping woman or child
- Punishment: Shall punished with imprisonment for life or rigorous imprisonment not exceeding 14 years and also with fine.
- Section 08: Taking Ransom
- Punishment: Shall punished with death or imprisonment for life and also with fine.
- Section 09: Rape or death in consequence of Rape
- Punishment:
i) If commits rape: Shall be punished with death (Amended on 2020) or imprisonment for life and also with fine.
ii) Death in consequence of rape: Shall punished with death or imprisonment for life and also with fine not exceeding One Lac Taka.
iii) Gang Rape: Shall punished with death or imprisonment for life and fine not exceeding One Lac Taka.
iv) Attempt to cause death or injure after rape: Shall punished with death or imprisonment for life and fine.
v) Attempt to commit Rape: Shall punished with rigorous imprisonment up to 10 years but not less than 05 years and fine.
