What is Trademark ? 

Trademark is a recognizable Mark, Word, Logo, Phrase, Symbol, Image or Distinctive Sign, Design or Expression or a combination o these elements used by an Individual, Company, Organization or other Legal Entity to allow Consumers to identify the source of the Goods or Service and to distinguish them from others in the same industry. 

A registered Trademark gives the trademark owner the exclusive right to use the mark and also prevent others from using the same mark. Trademark application can be filed in Two Categories in Bangladesh such as: 

(1) Ordinary Application

(2) Convention Application

Generally the following Trademark Symbols are used in Bangladesh:

Both Bangladeshi Nationals and Foreigners can apply claiming to be the proprietor of a Trademark to the Registrar for Registration of the Mark. Foreign Applicants must have to be apply through their Local Representatives.

In Bangladesh Department of Patents, Designs and Trademarks (DPDT) is the concern Government Authority for Trademark Registration. 

  • What are the Applicable Laws relating to Trademark in Bangladesh ? 

The Applicable laws relating to Trademark Registration in Bangladesh are as follows:

  2. The Trademark Rules 2015

Trademark Registration Procedure in Bangladesh

Stage 1: Filing

The Applicant have to file an Application to the Registrar in the Prescribed Form for registration of the desire Trademark.

Stage 2: Examine by the Registrar

In this Stage, the Registrar examines the trademark application and the desire Mark in compliance with the provisions of the Applicable Laws

Generally it takes 08-12 months from the date of filing. 

 

Stage 3: Publication

After examining the Trademark if the Registrar is satisfied, the mark will be published in the Trademark Journal for objection purposes. 

The Applicant have to paid the prescribed publication fees.

It will also takes 08-12 months from the date of submitting publication fees. 

Stage 4: Registration

After publishing the mark in the Trademark Journal if the Registrar did not receive any Objection regarding the desire mark then the Registrar shall issue a Certificate of Registration to the Applicant. 

The Registration of the Trademark shall be given for a initial period of 7 Years

  • Trademark Renewal in Bangladesh 

In Bangladesh a Trademark can be renewed from time to time upon payment of the renewal fees for an unlimited period of time. Each Renewal term is a period of 10 Years

For Renewal of a Trademark the Applicant have to apply to the Registrar in the Prescribed Form.
