The Civil Courts in Bangladesh are constituted by the The Civil Courts Act, 1887 . The ordinary and special jurisdiction of the Civil Courts are also administered by the said Act. The Civil Courts Act, 1887 has amended in 2021 and named as The Civil Courts (Amendment) Act, 2021 to extent the Pecuniary Jurisdiction of the Civil Courts. In this we have discussed about the changes which are amended by the amendment. 

Civil Courts in Bangladesh:

According to Section 3 of the Civil Courts Act, 1887 there shall be following classes of Civil Courts in Bangladesh, namely: 

  1. The Court of the District Judge 
  2. The Court of the Additional District Judge 
  3. The Court of the Joint District Judge 
  4. The Court of the Senior Assistant Judge 
  5. The Court of the Assistant Judge

The Civil Courts (Amendment) Act, 2021

By the Civil Courts (Amendment) Act, 2021 Section 19 and Section 21 of the Civil Courts Act, 1887 has been amended. Such as follows: 

Section 19 of the Civil Courts Act 1887 has  amended as follows: 

The jurisdiction of a Senior Assistant Judge and an Assistant Judge shall extend to all suits of which the value does not exceed 25 (twenty five) lac Taka and 15 (fifteen) lac Taka respectively.

Section 21 of the Civil Courts Act 1887 has amended as follows: 

An appeal from a decree or order of a Joint District Judge shall lie-

(a) to the District Judge where the value of the original suit in which or in any proceeding arising out of which the decree or order was made did not exceed 5 (five) crore Taka; and

(b) to the High Court Division in any other case.

DIFFERENCE BETWEEN BEFORE/AFTER AMENDMENT:

The Civil Courts Act, 1887

Before the amendment the Pecuniary Jurisdiction of the Civil Courts (Section 19) was as follows : 

  1. District Judge 
  2. Additional District Judge 
  3. Joint District Judge: From 4,00,001 to up to Unlimited.
  4. Senior Assistant Judge: From 2,00,001 to up to 4 Lac.
  5. Assistant Judge : up to 2 Lac.

 

Before the amendment the Appellate Pecuniary Jurisdiction of the Joint District Judge (Section 21) was as follows :

An appeal from a decree or order of a Joint District Judge shall lie-

to the District Judge 

where the value of the original suit in which or in any proceeding arising out of which the decree or order was made did not exceed 5 (five) Lac Taka. 

The Civil Courts (Amendment) Act, 2021

By the amendment the Pecuniary Jurisdiction of the Civil Courts (Section 19) has amended as follows : 

  1. District Judge 
  2. Additional District Judge 
  3. Joint District Judge: From 25,00,001 to up to Unlimited.
  4. Senior Assistant Judge: From 15,00,001 to up to 25 Lac.
  5. Assistant Judge : up to 15 Lac.

 

By the amendment the Appellate Pecuniary Jurisdiction of the Joint District Judge (Section 21) has amended as follows :

An appeal from a decree or order of a Joint District Judge shall lie-

to the District Judge 

where the value of the original suit in which or in any proceeding arising out of which the decree or order was made did not exceed 5 (five) Crore Taka.
